DIVORCE

Divorce is not as easy and simple as one may think. Depending upon various factors it involves your marriage that is being dissolved for one reason or another, your children and your property. It’s on thing to say I am going to file for divorce. It is quite another to achieve an appropriate dissolution of your marriage that can and will affect you for years to come if not the rest of your life.

DIVISION OF PROPERTY

Division of property involves real estate, motor vehicle, stock, retirements plans, IRA’s and basically everything you own. Many people think it is only real estate that is not the case. There are two (2) types of property. Separate property and community property. Texas is a community property state. Only community property can be divided by the Court. Division of property includes the division of debts, charge accounts and tax liabilities that have been incurred during the marriage.  The law in Texas does not require an equal division of property.

MINOR CHILDREN

Minor children can be in some cases one of the most difficult aspects of your divorce. Custody which is now referred to in the State of Texas asconservatorship is very emotional. Joint Conservatorship is presumed to be in the best interests of the minor children. Visitation or access in most cases is governed by what is called the Standard Order of Possession. Child Support is governed by the Guidelines  for Child Support that have been established by the Supreme Court of Texas. You should understand the law is not black and white and there are great variations on all of these issues.
